Blocking Films with Trademarks on Products in Them

Posted by cmdln on April 7th, 2007

To me, trademark has always seemed like the odd little step child of intellectual property law. Whereas patents and copyrights are about encouraging progress, although others interpret them to be about rewarding creators, trademarks are clearly meant to be a consumer protection.

Exactly how product placement in a film is a trademake issue is a bit of a mystery to me. If the film in question is not misrepresenting the product, that is potentially confusing a consumer over who owns and produces the product, then how exactly does it have anything to do with trademark?

I guess it is just the latest activity in an established trend of overreaching and misuse of intellectual property laws in general.
