Came across this in the GL News Picks feed. I haven’t started digging into software patents, so much, but I think this is a fairly astute insight, speaking as a hacker. I rather suspect this view would form a pretty good basis for arguing against software patents. You should also note that Fogey isn’t saying software should be unprotected, but rather that copyright would seem to be sufficient, at least the way he argues it.
